Course Description

The Holistic Youth Defense Clinic will provide students an opportunity to practice holistic and zealous lawyering by representing juvenile clients on delinquency matters, as well as related school discipline and special education matters, in order to help keep youth in their homes, schools, and communities with appropriate supports. Law students will have the opportunity to handle cases from the initial intake to the case disposition and subsequent appeal (if any).

Clinic students will conduct client and witness interviews, conduct legal research and analysis, draft memoranda and pleadings, participate in fact investigation and case planning, negotiate with Asst. Commonwealth’s attorneys, counsel clients, represent clients at trials, hearings, and other proceedings, and draft client transition memos.

Other Course Details

Prerequisites: (Civil Procedure (6000)) AND (Criminal Law (6003)) Evidence and Prof. Responsibility are required prerequisites for 3Ls wanting to appear in court with a 3L practice certificate. Moreover, because the credits in this course count toward the JD Program Professional Skills requirement, JD candidates will be given enrollment priority for this class. Concurrencies: Evidence, Prof. Responsibility, Trial Advocacy Criminal Investigation, Criminal Adjudication, and/or Criminal Procedure Survey all recommended, but not required as pre- or co-requisites.

Exclusive With: Students who have or are enrolled in another clinic must obtain permission from the Director of Clinics to participate in this clinic to avoid conflicts of interest.

Course Notes: Students interested in obtaining a seat in this clinic must (1) submit an application via the process announced/administered by Prof. Shalf, Dir. of Clinical Programs, and (2) prioritize this clinic in the lottery process for clinics administered by SRO in October. NOTE REGARDING CREDITS: students in this clinic will receive a grade of Honors (H), Pass (P) or Fail (F) at the conclusion of the semester. In accordance with Academic Policy, H and P grades do not earn grading points, so they do not contribute to a student's grade point average (GPA).
