Course Description

This elective is intended to assist those with follow-on assignments in military justice, or students who simply wish to broaden their understanding of victims’ rights in American criminal jurisprudence. Students will understand the origins of victims’ rights, from the historical pre-18th century victim-driven prosecution system, through the rise of public prosecutors. Historically, this shift from private to public-efficiency based prosecutions has corresponded with the degradation of victims’ rights. Students will be able to identify the major stages of the modern victims’ rights movement, and analyze the impacts of developing victims’ rights on civilian and military criminal prosecutions. The course will be focused on reviewing case law and scholarly works.

Course Notes: The instructors for this course are MAJ HARTSFIELD and MAJ MORGAN. This course meets at the JAG School during its 4th Quarter, MARCH 18 – MAY 3, 2024 (NOTE: the course ends during the Law School’s final exam period). Due to weather, holidays, military requirements, etc., individual class sessions at the JAG School are subject to rescheduling on occasion. The JAG School attempts to reschedule make-ups at the same day/time slot, but there may be times when a meeting session date/time will not occur in the same day/time slot. All absences must be approved by the instructor. ENROLLMENT: Students seeking to enroll in this course must complete and timely submit a request e-form to SRO. SRO will begin collecting enrollment applications at an announced time in the fall term, and the JAG School has final approval for any enrollment requests. The JAG School and Law School intend to finalize the roster of approved UVA Law students in this course by Jan. 26.
