Course Description

This elective focuses on crimes and defenses commonly faced by military justice practitioners. Designed with the Chief of Justice (or service equivalent) or Senior Defense Counsel in mind, students will discuss current trends and new developments in common military crimes and defenses, and develop/analyze charging and defense philosophies. This elective will assist practitioners with crafting a case theory, drafting appropriate charges, identifying and formulating defenses and potential motions, as well as assessing and mentoring these skills in subordinates. This elective is broadly structured for both experienced advocates seeking a more advanced understanding as well as those seeking a refresher in this area of the law. Students should gain an understanding of not only how to prepare charges and formulate defenses, but also be able to explain why they decided on a particular approach. Class is a seminar format.
