Course Description

This seminar will examine the contours of the police power, the foundational government power to regulate health, safety, and morals. Particular attention will be paid to the limits placed on the police power by the due process and takings clauses of the Constitution, as well as to the expansive use of the police power in times of crisis.

Written Work Product

Students will have the option to write one long paper due at the end of the semester or several shorter papers over the course of the semester. Students opting to submit the shorter papers throughout the semester will submit them directly to the instructors (not via EXPO). Students opting to submit a substantial research paper at the end of the semester must do so via EXPO by noon on December 20th.. Moreover, students intending to use the research paper to satisfy their Upper-Level Writing Requirement must submit a "Special Request" form to SRO (available via LawWeb) by October 3, 2023.
